No guarantee of listing accuracy, pricing, or availability

vive.us does not guarantee the accuracy, completeness, or timeliness of any listing information, including but not limited to pricing, square footage, features, availability, or contact details. Listing data may be supplied by third parties or users, and we do not independently verify every listing. You are responsible for confirming all material facts with the listing advertiser or agent before relying on them.

Listings may change or be removed without notice

Listings may be updated, changed, or removed at any time without prior notice. Availability, rent, and terms are subject to change. vive.us is not responsible for listings that are no longer available or that have been modified or removed.

Marketplace / lead-generation platform; not a party to leases

vive.us operates as a rental marketplace and lead-generation platform. We connect renters with listing advertisers, agents, and landlords. Unless expressly stated in a separate written agreement, vive.us is not a party to any lease, rental agreement, or transaction between users. Any lease or rental agreement is solely between the renter and the property owner, manager, or authorized agent. vive.us does not guarantee the outcome of any inquiry, application, or transaction.

User-submitted content

Users may submit content such as listing information, photos, descriptions, and messages. You are responsible for the content you submit. By submitting content, you represent that you have the right to do so and that it does not violate these Terms or any applicable law. You grant vive.us a non-exclusive, royalty-free, worldwide license to use, display, and distribute user-submitted content in connection with operating the platform.

Prohibited content and conduct

You may not use vive.us to:

• Post false, misleading, or fraudulent listing information
• Advertise properties without legal authority or permission
• Discriminate or post content that violates fair housing or equal-opportunity laws
• Infringe intellectual property or other rights of third parties
• Harass, defame, or harm others or use the site for illegal purposes
• Scrape, automate access, or overload the site in a way that impairs its operation

Violation of these rules may result in removal of content, suspension or termination of your account, and, where appropriate, referral to authorities.

Right to remove listings, content, or accounts

vive.us reserves the right, in its sole discretion, to remove or reject any listing or other content, and to suspend or terminate any account, at any time and without prior notice. We may do so for compliance with our policies, applicable law, protection of users, or operational reasons. We are not liable to you or any third party for such removal or termination.

Intellectual property

The vive.us name, logo, and the design and content of the site (other than user-submitted content) are owned by vive.us or its licensors and are protected by intellectual property laws. You may not copy, modify, or use our trademarks or site content for commercial purposes without our prior written consent.

Limitation of liability

To the fullest extent permitted by law, vive.us and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the site or any listing, inquiry, or transaction. Our total liability for any claims arising from these Terms or your use of the site shall not exceed the amount you paid to vive.us in the twelve (12) months preceding the claim, or one hundred U.S. dollars ($100), whichever is greater. Some jurisdictions do not allow certain limitations of liability; where prohibited, such limitations may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless vive.us and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the site, your violation of these Terms, your violation of any law or the rights of a third party, or any content you submit.

Governing law; disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of vive.us shall be resolved in the state or federal courts located in Florida, and you consent to the personal jurisdiction of such courts. We reserve the right to update this governing-law and dispute provision; the version in effect at the time of the relevant conduct applies.

Changes to these Terms

vive.us may update these Terms at any time by posting a revised version on this page. Your continued use of the site after changes constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
